Terms of Service for Arizona Web Developer (A DBA of Consumer Funnels LLC)

These Terms of Service (“Terms”) govern the use of services provided by Arizona Web Developer, a DBA of Consumer Funnels LLC (“we,” “our,” “us”). By accessing our website, purchasing services, or engaging with our Authority Domain rental services, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using our services.
1. Definitions
- “Services”: Refers to all offerings by Arizona Web Developer, including custom web design, web development, SEO services, digital marketing, hosting, Authority Domain rentals, and related support.
- “Client”: Any individual or business entity that engages with Arizona Web Developer to use our services.
- “Website”: Refers to any site designed, developed, or hosted by Arizona Web Developer.
- “Authority Domain”: Premium domains provided by Arizona Web Developer for rental that are optimized for SEO and branding.
2. Acceptance of Terms
By purchasing, accessing, or using any of our services, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree to these Terms, you may not use our services.
3. Services Offered
Arizona Web Developer offers a range of digital services, including:
3.1 Web Design & Development
- Custom website creation tailored to the Client’s business needs.
- SEO-optimized design focused on enhancing online visibility and user experience.
- Websites are fully customizable to align with the Client’s brand and goals.
3.2 Authority Domain & Website Rentals
- Clients can rent high-ranking, SEO-optimized authority domains on a monthly basis.
- These domains are pre-optimized for specific industries and come with fully developed websites, lead generation tools, and SEO features.
- The Client has full access to customize the website to fit their branding while benefiting from the domain’s established SEO authority.
- Rentals are flexible and can be canceled at any time without penalty (subject to Section 7).
3.3 Digital Marketing & SEO
- We offer comprehensive SEO strategies, including keyword optimization, content creation, and on-page SEO services.
- Digital marketing services include social media marketing, pay-per-click (PPC) advertising, and email marketing campaigns.
- Each digital marketing service is customized to target specific audiences and drive measurable results.
3.4 Hosting, SSL & Cloudflare Security
- Hosting services include fast, reliable hosting infrastructure with SSL certification and Cloudflare integration.
- Our services guarantee secure and efficient website performance, enhanced data protection, and faster load times.
4. Payment Terms
4.1 Fees
Clients agree to pay the fees for services in accordance with the pricing outlined in their contract or invoice. Fees may include:
- Web design and development fees (one-time or ongoing).
- Monthly rental fees for Authority Domains and websites.
- Digital marketing and SEO fees.
- Hosting and security service fees.
4.2 Payment Methods
Payments are processed through third-party payment gateways. The Client agrees to provide accurate billing information and authorizes Arizona Web Developer to charge the designated payment method for all fees due.
4.3 Late Payments
Failure to make timely payments may result in suspension or termination of services. We reserve the right to charge late fees for overdue invoices, subject to applicable law.
4.4 Taxes
Clients are responsible for any applicable taxes related to the purchase of services. The pricing provided does not include taxes unless stated otherwise.
5. Authority Domain & Website Rental Terms
5.1 Domain Rental Agreement
- Clients renting an Authority Domain will have full use of the domain and the associated website for the duration of the rental period.
- Clients are responsible for customizing the website to meet their branding needs, and we provide technical support to ensure smooth operation.
5.2 Rental Period & Renewal
- Authority Domains are rented on a monthly basis, and the Client may renew their rental for additional periods. Fees are due monthly, and failure to pay will result in termination of access to the Authority Domain.
5.3 Cancellation Policy
- Clients can cancel their domain rental at any time without penalty. However, Arizona Web Developer must be notified in writing at least 14 days before the next billing cycle.
- Upon cancellation, the Client will lose access to the Authority Domain and any associated services unless prior arrangements are made.
6. Refund Policy
All payments made for services, including Authority Domain rentals, web design, digital marketing, and SEO, are non-refundable. In exceptional circumstances, refunds may be issued at the sole discretion of Arizona Web Developer.
7. Termination of Services
Arizona Web Developer reserves the right to terminate any Client’s services for breach of these Terms or failure to pay outstanding fees. In the event of termination, the Client’s access to the Authority Domain, website, or digital marketing services will be revoked, and any unpaid balances will remain due.
8. Intellectual Property
All content, code, and design elements created by Arizona Web Developer remain the intellectual property of Arizona Web Developer unless otherwise stated in a contract. Clients may use the website and Authority Domain while under contract but may not resell, distribute, or claim ownership over any content without written consent.
9. Client Responsibilities
9.1 Content Submission
Clients are responsible for providing all content, including images, text, and other materials, required for web development or marketing services. Clients must ensure that all content is accurate, lawful, and free of copyright infringement.
9.2 Compliance
Clients are responsible for complying with all applicable laws, including those governing privacy, copyright, and online transactions. Arizona Web Developer is not liable for any legal claims resulting from the Client’s website or marketing activities.
10. Limitation of Liability
To the fullest extent permitted by law, Arizona Web Developer and Consumer Funnels LLC shall not be held liable for any indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use our services. This includes, but is not limited to, loss of revenue, loss of data, or loss of business opportunities.
11. Warranties and Disclaimers
Arizona Web Developer provides services “as-is” and disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we strive for accuracy and reliability, we do not guarantee specific results from our digital marketing or SEO services.
12. Privacy
Our collection and use of personal information are governed by our Privacy Policy. Clients agree to the terms outlined in the Privacy Policy when using our services.
13. Changes to the Terms of Service
We reserve the right to update these Terms of Service at any time to reflect changes in our services or legal requirements. The most recent version of the Terms will be posted on our website, and it is the Client’s responsibility to review them periodically.
14. Governing Law
These Terms are governed by the laws of the state of Arizona. Any disputes arising from the use of our services shall be resolved in the courts of Maricopa County, Arizona.
